General terms and conditions for Autopay

These general terms and conditions (the “General Terms and Conditions”) apply to the agreement (the “Agreement”) for parking services (the “Service”) concluded between Parkman i Sverige AB, company registration number 556614-8853, (“Parkman”) and the natural or legal person (the “Customer”) who is the owner of a vehicle that enters and/or is parked within a parking facility or garage provided by Parkman (the “Parking Facility”). In these General Terms and Conditions, the owner of a vehicle means the same as the vehicle’s owner as defined in the Act (1984:318) on control fees in cases of unauthorized parking.

About Autopay

1.1 Parkman uses the Autopay parking system, which means that the licence plate of the Customer’s vehicle is recorded by cameras when entering and exiting the Parking Facility. The Customer does not need a physical parking ticket to use the Service.

Conclusion and termination of contracts

2.1 The agreement between Parkman and the Customer on the use of the Service is concluded when the Customer or someone using the Customer’s vehicle enters the Parking Facility.
2.2 When the Customer’s vehicle enters the Parking Facility, the Customer accepts these General Terms and Conditions. Acceptance of these General Terms and Conditions is a condition for using the Service. If the Customer does not accept these General Terms and Conditions, it means that the Customer’s vehicle is parked within the Parking Facility in violation of the agreed terms and conditions (unauthorized parking).
2.3 After the registered exit, the Agreement is terminated when all the Customer’s obligations under the Agreement have been fulfilled.

Parking fee

3.1 The Customer is obliged to pay a parking fee to Parkman for the use of the Service. Prices and fees for the Service are displayed in the vicinity of the Parking Facility on signs and at pay machines. All prices and fees are inclusive of VAT.
3.2 The amount of the parking fee is calculated according to the time the Service is used, i.e. the time between the Autopay system registering the Customer’s vehicle entering and exiting the Parking Facility.

Payment

4.1 The Customer’s payment for the Service shall be made in arrears through one of the payment options offered by Parkman as indicated at the pay machine for the Parking Facility:
a) payment at a pay machine;
b) automatic payment by registering an account at www.parkman.nu or www.autopay.io;
c) Easypark application;
d) payment within 48 hours at www.parkman.nu or www.autopay.io; or
e) invoice.
4.2 If the Customer has chosen to register an account at http://www.autopay.io, the Customer’s bank account will be debited automatically upon exit from the relevant Parking Facility in accordance with the terms and conditions accepted by the Customer upon registration, with payment being made in accordance with paragraph 4.1 b) above.
4.3 In the event that a pay machine is out of order, the Customer is obliged to arrange for payment to be made by another payment method.
4.4 If the Customer does not pay by one of the payment options a) – d) according to point 4.1 above, Parkman will send an invoice by post to the Customer’s officially recorded or registered address. An invoicing fee will be added to the invoice.
4.5 Parkman has the right to charge a fee for reminders and compensation for collection costs in accordance with applicable legislation. In the event of late payment, interest is charged in accordance with the Interest Act (1975:635).
4.6 If the Customer’s vehicle was being driven by someone else when using the Service, the Customer is jointly and severally liable with the driver of the vehicle for the performance of the Agreement.

Disclaimer

5.1 Parkman is not liable for damage or injury caused to the Customer unless Parkman has caused the damage or injury to the Customer through willful misconduct or gross negligence.
5.2 Parkman is not liable for damage resulting from the Customer or another person parking his/her vehicle in violation of the law, regulations or signage.
5.3 Parkman’s liability is limited to direct damage. Parkman is not liable for any indirect or consequential damages.
The Customer’s other commitments
6.1 The customer is responsible for ensuring that the vehicle licence plate is visible and legible to the Autopay system when entering and leaving the

Parking Facility.

6.2 The Customer undertakes to park in accordance with the instructions and signage in force at the relevant Parking Facility at all times. The Customer is obliged to take note of and comply with all the regulations, signs and local provisions in force at the relevant Parking Facility at all times.

Force majeure

7.1 Parkman shall be exempted from penalty for failure to perform any obligation under the Agreement if Parkman’s performance is rendered impossible, substantially impeded or substantially delayed by
an epidemic, act of war, accident, labour dispute, fire, explosion, intervention by a public authority or any other circumstance beyond Parkman’s control.

Changes to terms and conditions

8.1 Parkman reserves the right to amend these General Terms and Conditions at any time. The General Terms and Conditions currently in force are available on the Parkman website, www.parkman.nu.

Personal data

9.1 Parkman processes personal data in accordance with the General Data Protection Regulation (GDPR) and applicable data protection legislation.

Disputes and applicable law

10.1 Disputes arising from the Agreement shall be settled by the general court with Stockholm District Court as the first instance.
10.2 Swedish law shall apply to the Agreement.
