These general terms and conditions (the “General Terms”) apply to the agreement (the “Agreement”) regarding parking services (the “Service”) entered into between Parkman i Sverige AB, company reg. no. 556614-8853, Box 2895, SE‑187 28 Täby, Sweden (“Parkman”) and the natural or legal person (the “Customer”) who is the owner of a vehicle entering and parking within a parking facility or garage provided by Parkman (the “Parking Facility”).

For the purposes of these General Terms, “owner of a vehicle” shall have the same meaning as the owner of a vehicle under the Swedish Act (1984:318) on Parking Fines for Illegal Parking. If, when using the Service, the vehicle is driven and parked by someone other than the owner, what is stated in these General Terms regarding the Customer shall also apply to the driver. In such cases, the owner and the driver shall be jointly and severally liable for the performance of the Agreement.

1. Autopay

1.1 Parkman uses the Autopay parking system, which means that the registration number plate of the Customer’s vehicle is recorded by cameras upon entry to and exit from the Parking Facility. Accordingly, the Customer does not require a physical parking ticket to use the Service.

2. Formation and Termination of the Agreement

2.1 The Agreement between Parkman and the Customer for the use of the Service, including these General Terms, is concluded when the Customer enters the Parking Facility, provided that the Customer’s vehicle remains within the Parking Facility for at least 15 minutes.

2.2 Acceptance of these General Terms constitutes a condition for use of the Service. If the Customer does not accept these General Terms, this means that the Customer’s vehicle is parked within the Parking Facility in violation of the applicable conditions (illegal parking). Information about these General Terms and where they are available in full is displayed on signage at the Parking Facility.

2.3 Following registered exit, the Agreement terminates once the Customer has fulfilled all obligations under the Agreement.

3. Parking Fee

3.1 The Customer is obliged to pay a parking fee to Parkman for the use of the Service. Prices and fees for the Service are displayed in connection with the Parking Facility on signage and, where applicable, at payment machines. All prices and fees are stated inclusive of VAT.

3.2 The parking fee is calculated based on the time during which the Service is used, i.e., the time between the registration of entry and exit of the Customer’s vehicle by the Autopay system at the Parking Facility.

4. Payment

4.1 Payment for the Service shall be made either in connection with the use of the Service or subsequently through one of the payment methods offered by Parkman, as indicated on signage or at any payment machine at the Parking Facility.

4.2 Payment may be made in one of the following ways:

(a) at a payment machine, if applicable;
(b) automatically by registering an account with Autopay at www.parkman.nu or www.autopay.io;
(c) via a third-party application, e.g., EasyPark, Parkster or another available application;
(d) by following payment instructions on www.parkman.nu or www.autopay.io within 48 hours from the vehicle’s exit from the Parking Facility; or
(e) by invoice in accordance with clause 4.5 below.

4.3 If the Customer has chosen to register an account at www.autopay.io, the Customer’s bank account will be automatically debited upon exit from the relevant Parking Facility in accordance with the terms accepted upon registration. Payment shall thereby be deemed made pursuant to clause 4.2(b) above. In addition to the parking fee, a service fee of SEK 4.95 per parking occasion will be charged for the use of the Service.

4.4 If a payment machine is out of order, the Customer is obliged to ensure that payment is made using another available payment method.

4.5 If the Customer does not make payment through any of the methods set out in clause 4.2(a)–(d), Parkman will send an invoice with 30 days’ payment terms by post to the registered address of the vehicle owner. The invoice will be issued after the expiry of the 48‑hour period referred to in clause 4.2(d) without registered payment. An invoice fee of up to SEK 59 will apply.

4.6 Parkman is entitled to charge fees for payment reminders and compensation for debt collection costs in accordance with applicable legislation. In the event of late payment, default interest shall be charged pursuant to the Swedish Interest Act (1975:635).

4.7 If the Customer fails to pay the parking fee for the use of the Service, Parkman may impose a parking fine in accordance with the Swedish Act (1984:318) on Parking Fines for Illegal Parking.

5. Limitation of Liability

5.1 Parkman shall not be liable for any damage suffered by the Customer unless Parkman has caused such damage through wilful misconduct or gross negligence.

5.2 Parkman shall not be liable for any damage resulting from the Customer or another party parking the vehicle in violation of law, regulations, or signage.

5.3 Parkman’s liability is limited to direct damage. Parkman shall not be liable for any indirect, incidental, or consequential damage.

5.4 The holder of the Autopay account is responsible for ensuring that the information in the registers/agreements with Parkman and Autopay is accurate.

6. Customer’s Other Obligations

6.1 The Customer is responsible for ensuring that the vehicle’s registration number plate is visible and readable for the Autopay system upon entry to and exit from the Parking Facility.

7. Parking Facility

7.1 The Customer undertakes to park in accordance with the instructions and signage applicable at the Parking Facility at any given time. The Customer is obliged to review and comply with all applicable regulations, signage, and local rules at the Parking Facility at all times.

8. Force Majeure

8.1 Parkman shall be exempt from liability for failure to perform its obligations under the Agreement where such performance is prevented, significantly impeded, or rendered substantially more onerous due to epidemic, war, accident, labour dispute, fire, explosion, actions by public authorities, or any other circumstance beyond Parkman’s control.

9. Amendments to Terms

9.1 Parkman reserves the right to amend these General Terms at any time. The General Terms in force from time to time are available on Parkman’s website, www.parkman.nu.

10. Personal Data

10.1 Parkman processes personal data in accordance with the General Data Protection Regulation (GDPR) and applicable data protection legislation.

11. Disputes and Governing Law

11.1 Any dispute arising from the Agreement between Parkman and the Customer shall be settled by a general court. If the Customer is not a consumer, the Stockholm District Court shall be the court of first instance. Actions concerning parking fines under the Swedish Act (1984:318) on Parking Fines for Illegal Parking shall be brought before the district court in the locality where the illegal parking occurred.

11.2 The Agreement shall be governed by Swedish law.
